You represent to Fuzyon Media, LLC dba Fuzyon Ai that you are lawfully able to enter into contracts. If you are entering into these Terms for an entity, you represent that you have authority to bind that entity. You and Fuzyon Media, LLC dba Fuzyon Ai are collectively referred to as the “Parties” and each is a “Party.”

These Terms do not govern the use of the digital customer loyalty program service as well as other services (the “Service”) operated by Fuzyon

By providing your phone number and opting in to receive text messages from Fuzyon Media, LLC dba Fuzyon Ai, you agree to the following:

Program Name & Description: Fuzyon Media, LLC dba Fuzyon Ai SMS Alerts. You may receive SMS/MMS messages regarding account updates, AI-driven lead notifications, onboarding updates, appointment scheduling, product announcements, marketing automation tips, and occasional promotional offers.

Message Frequency: Message frequency varies. You may receive up to 6 messages per month.

You represent that you will comply with all Applicable Laws, including anti-bribery, anti-corruption, and export control laws. You represent that you are not a Sanctions Target prohibited from receiving services from Fuzyon Media, LLC dba Fuzyon Ai.
9. Global Availability.
Fuzyon Media, LLC dba Fuzyon Ai controls the Site from offices in Florida, US. If you use this website from other locations, you are responsible for compliance with local Applicable Laws.
10. Indemnity.
You agree to defend, indemnify, and hold harmless Fuzyon Media, LLC dba Fuzyon Ai, its affiliates, and their respective employees and directors from any claims, damages, or expenses arising out of your use of the Site or breach of these Terms.
11. Disclaimers.

12. Limitation of Liability.
TO THE FULLEST EXTENT PERMITTED BY LAW, Fuzyon Media, LLC dba Fuzyon Ai SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. THE COMPANY’S CUMULATIVE LIABILITY SHALL NOT EXCEED TWO HUNDRED U.S. DOLLARS ($200.00).
13. Governing Law.
This Agreement will be interpreted, construed, and enforced in all respects in accordance with the laws of the State of Florida, without reference to its choice of law principles. Any legal action or proceeding arising under or relating to this Agreement shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and the Parties expressly consent to personal jurisdiction and venue in those courts.
14. Miscellaneous.
These Terms constitute the complete agreement between the Parties. These Terms do not create any partnership, joint venture, or agency relationship. If any provision is held invalid, the remainder shall continue in full force.
